1. General
1.1 These General Terms and Conditions apply to all orders placed via the website, by email, private message, telephone or personally and are aimed exclusively at consumers. Deliveries, services and offers from pipe maker Christian Ruetz (ruetzpipes) are made exclusively on the basis of these terms and conditions - all deviations must be in writing and must be approved by pipe maker Christian Ruetz (ruetzpipes). These GTC also apply as a framework agreement for all further legal transactions between the contracting parties.
1.2 Purchasing products from pipe maker Christian Ruetz (ruetzpipes) is not permitted for persons under the age of 18.
1.3 Prices not including shipping costs, not including possible customs duties, no VAT due to § 6 Abs. 1 UStG.
1.4 All sketches are the intellectual property of Christian Ruetz (ruetzpipes). No right to use without explicit permission!
2. Conclusion of contract
The products on the website represent a non-binding offer to conclude a contract for the corresponding item. Deviations from the illustrations and descriptions are possible. The purchase contract with Christian Ruetz (ruetzpipes) is concluded when you confirm the purchase after receiving all relevant information by email or message .
3. Contract Language
The contract languages are German or English.
4. Terms of Delivery
4.1 Shipping costs are added to the stated product prices. These are based on the applicable standard rate of the post office or forwarding agency - plus a surcharge for packaging that is customary in the industry.
4.2 Alternatively, you are free to pick up the products after calling Christian Ruetz (Dornachweg 25a, 6424 Silz, Austria).
4.3 Any customs duties to be paid by the recipient are not included in the costs.
4.4 Products that are in stock will be shipped within 3 working days after full payment. Custom-made products are shipped in accordance with the special conditions agreed in writing.
4.5 Risk and chance pass to the buyer upon acceptance of the goods. You bear the transport risk according to the generally applicable legal provisions, including the risks of breakage and shrinkage after shipment.
4.6 Transport damage must be reported in writing to the relevant delivery company within 24 hours of receipt of the goods. Please contact pipe maker Christian Ruetz (ruetzpipes) immediately in the event of transport damage and complaints - complaints and notices of defects must be communicated no later than 7 working days after receipt of the goods or within the period specified by the transport insurance company used.
5. Terms of Payment
5.1 Payment options for purchases from ruetzpipes (Christian Ruetz): prepayment, cash payment when pick up (outside of the EU: credit card, ApplePay, GooglePay)
5.2 The goods must be paid for within 7 working days. If no payment has been received within 14 days of placing the order, the sale will be considered invalid and the pipe will be included in the offer again.
5.3 Deliveries abroad may incur customs duties, taxes and fees that are not included in the total price shown.
5.4 Shipping after full payment.
5.5 Possible bank transfer fees must be paid by the customer.
6. Conditional sales contract
The goods remain the property of Christian Ruetz (ruetzpipes) until full payment has been made.
7. Right of Return and Right of Withdrawal
7.1 As a natural person, buyers who have made the purchase for private, non-commercial purposes have the right to return the goods within 14 days of receipt or to withdraw from the contract - terms: unused, no damages, unsmoked, original packaging, has not been tampered with. The withdrawal must be made in writing ( info@ruetzpipes.at ), the costs of the return shipment are payed by the buyer. This dispatch must take place within 14 days after notification of the withdrawal. Exception: When purchasing goods especially made to customer wishes, the statutory 14-day right of withdrawal for contracts concluded online or outside of business premises expires. This also applies if the ordered goods have not yet been produced.
7.2 There is a non-refundable 50–100 % standard commission down payment before the commission is started.
7.3 Sample Form in German
7.4 In the event of an effective withdrawal, the services received by both parties are to be returned. If the buyer cannot return the received goods in whole or in part or can only return them in a deteriorated condition, he or she must pay appropriate compensation. Buyers also have to bear the costs of the return shipment.
7.5 The refund of the purchase price is made by bank transfer - immediately as soon as the goods have arrived back at pipe maker Christian Ruetz (ruetzpipes).
7.6 Custom-made products are non-returnable.
8. Warranty and Guarantees
The statutory right to liability for defects applies.
9. Privacy
9.1 Pipe maker Christian Ruetz (ruetzpipes) strictly adheres to the current version of the Data Protection Act when storing and processing buyer data. The data will only be used for internal processing. More information here.
9.2 By sending a confirmation e-mail, buyers can agree to receive information material from pipe maker Christian Ruetz (ruetzpipes) for advertising purposes and that the e-mail data will be saved for this purpose. This consent may be revoked at any time.
10. Place of Performance and Law
10.1 The place of performance is the registered office of Christian Ruetz (ruetzpipes): Dornachweg 25a, 6424 Silz, Tirol, Austria
10.2 Austrian law applies to all disputes arising from the contract of use and these GTC.
11. Miscellaneous Provisions
The invalidity of individual provisions of these General Terms and Conditions does not affect the validity of the remaining provisions.
12. Dispute Resolution
The European Commission provides a platform for online dispute resolution, which you can find here . We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
